Collection of Personal Information
Mobile Neuro Rehab collects only personal information that is necessary for its functions or services and ensures that all information is collected by fair and lawful means. All personal information is only used for the purposes for which it was collected except where legal exemptions exist. All information collected by Mobile Neuro Rehab is collected by lawful and fair means and is, where practical to do so, collected directly from the client. The client is informed who is collecting the information, how it is stored and what it is used for. Personal information is collected by staff through phone calls, referrals, face-to-face appointments and assessments. All forms used for the collection of information are approved by the Mobile Neuro Rehab and are compliant with the Australian Privacy Principals.
The types of personal information that we collect may include;
- Client identifying information (Name, age, address)
- Identification and contact details for next of kin/ person responsible/ carer or guardian
- Referral information
- Social history
- Details of medical conditions
- Progress notes
- Other such information that is relevant for us to provide our services in the manner that the client has requested, or to comply with the Law.
Disclosure of personal information
Personal information is not disclosed to a person, body or agency (other than the individual concerned) unless;
- It is for the main reason it was collected (the primary purpose) or for a related secondary purpose e.g. an onward referral with the client’s consent
- The client, carer/guardian has consented to the disclosure.
- It is required by/or under law or requested by a board or tribunal with legal authority
- Where the client, carer/ guardian confidentiality is deemed to be diminished by a serious or imminent threat to the life, health or safety of the individual or of another person.
Consent to collect and share personal information
Clients will need to consent for the collection and disclosure of personal information. Clients or a representative have the choice to complete an electronic Consent to Collect and Share Information form (via Cliniko) or paper Consent to Collect and Share Information form. Clients have the right to decline or limit consent. Clients may be refused service with Mobile Neuro Rehab where they do not disclose or give permission for disclosure of personal information necessary for the safety of staff and clients.
Use of information within Mobile Neuro Rehab
Handling of information within Mobile Neuro Rehab and the use of personal information regarding clients is restricted to those within the agency who have a legitimate ‘need to know’. Information contained in client files is restricted to that necessary for the smooth running of the service and/or monitoring of service outcomes. Only staff members within the service have access to the client files and information relating to the clients unless the client has given prior written permission.
Client Access to personal information
Individuals have the right to request access to their personal records by requesting this with their therapist.
Security and storage of personal information
Mobile Neuro Rehab takes all responsible steps to protect personal information against misuse and provides safeguards to ensure against loss, unauthorised access, misuse, modification, or disclosure.
All client information is stored in a confidential practice management software (Cliniko) on a computer that is password protected with appropriate firewall protection.
Any paper documents with personal information will be destroyed or deidentified after being scanned to Cliniko.
All e-mails sent by Mobile Neuro Rehab have a privacy statement and security disclaimer.
Data breach or leak of personal information
In the unlikely event of a data breach or leak of personal information, Mobile Neuro Rehab will notify individuals whose personal information is involved in the data breach. This notification must include recommendations about the steps individuals should take in response to the breach. The Australian Information Commissioner must also be notified of eligible data breaches.
Note: an eligible data breach is one that is likely to result in serious harm to any individual affected.
